1. Scope

of application The following General Terms and Conditions (hereinafter referred to as “GTC”) apply to the use of this website (www.eddine.ch) as well as all legal relationships between Eddine Belaid Aveda exclusive Salon (hereinafter referred to as “EB”) and its contractual partners (hereinafter referred to as “Customers”).

The authoritative version of the GTC is the currently available version on the website. These T&Cs may be amended by EB at any time. Such amendments shall enter into force immediately upon their publication. EB’s offer is aimed at customers with Swiss residence. A customer is any natural person who enters into a contractual relationship with EB.

These T&Cs apply exclusively. Conflicting, supplementary or deviating conditions from these GTC require the express written deviation and confirmation by authorized representatives of EB in order to be valid. By using this website, the customer expressly agrees to these terms and conditions.

Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

2. Content and social media

EB’s website and its affiliated social media channels (e.g. Facebook, Instagram, TikTok) contain information about products and services. We reserve the right to change prices and product ranges as well as technical changes. All information on www.eddine.ch and the corresponding channels on social media (e.g. service and product descriptions, illustrations, films, accessory relationships and other information) is to be understood only as approximate values and in particular does not represent any assurance of properties or guarantees. EB does not assume any liability for the accuracy, completeness and up-to-dateness of the corresponding information. All offers on this website and on the corresponding social media are not to be understood as binding offers.

3. External appointment booking system

For the processing of appointment booking, EB uses the “Phorest” service operated by Ndevor Systems Ltd. (Ireland, Companies Registration Office, No 369210), Anglesea Mills, 9 Anglesea Row, Off Little Britain St, D07 F8PY Dublin, Ireland. The Client’s use of the appointment booking system is subject to Phorest’s separate terms of use

4. Conclusion

of contract The services and products shown on this website represent a non-binding invitation to the customer to submit a corresponding offer (e.g. appointment booking) to EB. By placing an order via this website, including the acceptance of these GTC, the customer submits an offer to conclude the contract. Offers made are binding for the customer. Unless otherwise noted, there is no right of withdrawal. The contract is concluded as soon as EB submits a declaration of acceptance (e.g. appointment confirmation).

5. Prices

All prices are in Swiss francs (CHF) and include value added tax (VAT). EB reserves the right to change the prices at any time. The prices published on the website are without guarantee. The prices valid at the time of conclusion of the contract according to the separate price list of the respective branch apply. The current price list is available on request from EB and in the corresponding branch. Accepted means of payment are listed in the relevant branch. EB reserves the right to demand an advance payment without giving reasons.

6. Place of performance and obligations of EB

Unless otherwise agreed, the contractual performance shall be performed by EB at the appropriately agreed location. For all other contractual services, EB’s registered office at Alfred-Escher-Strasse 23, 8002, Zurich, Switzerland, shall be deemed to be the place of performance, unless otherwise stipulated. EB undertakes to perform the contractual service in the best possible way to the satisfaction of the customer.

7. Obligations of the Customer

The Customer is obliged to pay the contractually owed purchase price and to take all precautions necessary for the provision of the contractual service by EB. The customer is generally obliged to make use of the contractual service. If the contractual service is not used, the customer is obliged to notify this within 24 hours before the appointment. If the customer fails to notify, EB reserves the right to invoice the contractual service despite not making use of it.

8. Warranty and liability

EB excludes any liability, regardless of the legal basis, as well as claims for damages against EB and any auxiliary persons and vicarious agents, insofar as this is legally permissible. In particular, EB is not liable for indirect damages and consequential damages, loss of profit or other personal injury or property damage to the customer (e.g. cloakroom). We reserve the right to further mandatory legal liability, for example for gross negligence or intentionally caused damage.


 

Impossibility of fulfilling the contract for which EB is not responsible (e.g. officially ordered closure, strike, operational disruptions) entitles EB to withdraw from
the contract in whole or in part. In such cases, EB may offer subsequent performance, but the Customer may not claim damages. 



 

EB explicitly excludes liability for third-party services via EB’s website and assumes no liability for damages arising from the use of EB’s websites, appointment booking system or social media channels. 



 

EB cannot guarantee access to the website, the appointment booking system or the availability of the branches by telephone.

9. Hair coloration for young people under the age

Of 16 Since November 1, 2011, certain coloration products have a note on the packaging that they are not intended for people under the age of 16. These hair dyes contain ingredients that can cause allergies. Temporary tattoos with “black henna” can increase the risk of allergies. In the case of facial rashes, sensitive, irritated or injured scalps, hair coloration is not recommended. With the consent of the parent or guardian, hair coloration can be carried out on adolescents under the age of 16.

10. Data protection

The provisions of EB’s data protection declaration , which form an integral part of these GTC, apply to data protection.

11. Intellectual Property

All rights and claims (e.g. copyrights, trademarks, patents, other intellectual property rights) arising from information and content of EB remain with the rights holder.

 

The total or partial reproduction, distribution, modification, linking, performance or other use of EB’s information and content for public or commercial
purposes is only permitted with the prior written consent of EB.

12. Applicable law and jurisdiction

The contract is exclusively subject to Swiss law. The place of jurisdiction for all disputes with EB is Zurich.
